At Artsy.com (“Artsy”), we have a few fundamental principles:
It is Artsy's policy to respect your privacy regarding any personal information we may collect while operating our website.
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
Gathering of Personal Information
We will share your personal information with third parties only in the ways that are described in this privacy statement. We do not sell your personal information to advertisers or third parties.
Certain visitors to Artsy choose to interact with Artsy in ways that require Artsy to gather personal information. The amount and type of information that Artsy gathers depends on the nature of the interaction. We collect this information from you in order to manufacture your order, send you order status updates, product updates, and respond to your customer service requests. For example, visitors who purchase products at Artsy are asked to provide a name, email address, mailing and billing address, and phone number. In such case, Artsy collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor's interaction with Artsy. You can always refuse to supply personal information, with the caveat that it may prevent them from engaging in certain website-related activities.
Payment information is stored securely on third party payment provider. We are not responsible for your personal credit card information and have secure access to that information only through secure tokens provided by the payment provider.
How Can You Access and Correct Your Personal Information?
Subject to the exceptions provided by the applicable law, Artsy will make available to you any specific personal information about you that it has collected, utilized or disclosed. Most of your personal information is available to you through your online account profile. If you require other information, please request the information by contacting Artsy. Please also provide us with details to help us understand your request and conduct our search for your information. We will need you to verify your identity before searching for or providing you with access to your information. We will respond to your access request within 30 days upon receiving all necessary information, or advise you in writing if we require additional time. Simply send your request for access to Artsy by email at the address set out below. We will use reasonable efforts to ensure that your personal information is kept as accurate, complete and up-to-date as possible. Artsy will not routinely update your personal information, unless such a process is necessary. In order to help Artsy maintain and ensure that your personal information is accurate and up to date, you must inform Artsy, without delay, of any change in the information you provided to Artsy.
How You Can Protect Your Privacy.
Never disclose your current PIN, passwords or answers to online personal verification questions to anyone, or you could be liable for losses. No Artsy employee or agent will ever ask you verbally or through e-mail for this information. Making sure that Artsy has your most up-to-date address or contact information will help protect your personal information from being misdirected. To protect your privacy online, you should, among other things, clear your browser's cache after each session, use a firewall, and use up to date software to protect your computer from viruses and spyware.
Like most website operators, Artsy collects non-personal information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Artsy's purpose in collecting non-personally identifying information is to better understand how Artsy's visitors use Artsy. From time to time, Artsy may release non-personal information in the aggregate, e.g., by publishing a report on trends in the usage of its website.
Artsy also collects potentially personal information like Internet Protocol (IP) addresses. Artsy does not use such information to identify its visitors, however, and does not disclose such information, other than under the same circumstances that it uses and discloses personal information, as described below.
Artsy may collect information that does not contain personal information in order for the purpose of creating statistics about the behavior of visitors to Artsy. For instance, Artsy may monitor the most popular pages on the Artsy site. Artsy may display this information publicly or provide it to others.
Protection of Certain Personal Information
Artsy discloses potentially personal and personal information only to those of its employees, contractors, partners and affiliated organizations that (i) need to know that information in order to process it on Artsy's behalf or to provide services available at Artsy, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors, partners and affiliated organizations may be located outside of your home country. By using Artsy, you consent to the transfer of such information to them.
Artsy may disclose personal information only in response to a subpoena, court order or other governmental request, or when Artsy believes in good faith that disclosure is reasonably necessary to protect the property or rights of Artsy, third parties or the public at large. If you are a registered user of Artsy and have supplied your email address, Artsy may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what's going on with Artsy and our products. You may change this setting in your account preferences.
Artsy takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of personal information.
We may post on Artsy.com, any photos, comments or testimonials you send us via email or post via Instagram, Twitter, Facebook or other social media site. If you wish to update or delete your photo or testimonial, please contact us.
Retargeting Information / Display Advertising
Artsy may implement and use Retargeting and Display Advertising provided by Google and Facebook.
Artsy and Google Analytics features display advertising and remarketing/retargeting.
Visitors are able to opt out of Google Analytics for Display Advertising and customize Google Display ads using the Ads Preferences Manager in Google.
Third-party vendors, including Google, show you ads on sites across the Internet.
Artsy and third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimize, and serve ads based on someone's past visits to a website.
Third Party Services
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.
If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

If Artsy, or substantially all of its assets were acquired, or in the unlikely event that Artsy goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Artsy may continue to use your personal information as set forth in this policy.
